Ministério Público pede bloqueio de R$ 24 milhões do ex-presidente Lula e do filho Luís Cláudio
Pedido se refere a uma ação dentro da Operação Zelotes em que Lula e o filho são réus. Defesa do ex-presidente diz que não há ‘base jurídica’ para o pedido de bloqueio.
Ministério Público Federal de Brasília pediu para a Justiça o bloqueio de R$ 24 milhões em bens e valores do ex-presidente Luiz Inácio Lula da Silva e do seu filho caçula, Luís Cláudio.
O valor de bloqueio solicitado pra Lula é de R$ 21,4 milhões e o do filho, Luís Cláudio, de R$ 2,5 milhões. Caberá à 10ª Vara da Justiça Federal de Brasília decidir sobre o caso.
O pedido do MP foi feito dentro de uma ação da Operação Zelotes em que Lula e o filho são réus.
A defesa do ex-presidente afirmou, em nota, que não há “base jurídica” nem “materialidade” para o pedido de bloqueio. O advogado de Lula, Cristiano Zanin, disse ainda que não há provas para as afirmações que o MP usa para justificar o pedido (veja a nota completa da defesa no final desta reportagem).
Lula é acusado de editar uma medida provisória para favorecer empresas do setor automotivo em troca de recebimento de propina. Luís Cláudio era ligado às empresas, de acordo com apurações da polícia.
Lula e o filho são investigados também por suspeita de favorecimento ao grupo sueco Saab nas negociações que levaram à compra pelo governo brasileiro de 36 caças do modelo Gripen.
O Ministério Público alega que Lula sabia, desde setembro de 2012, que os lobistas Mauro Marcondes e Cristina Mautoni, donos de uma empres de consultoria, diziam que tinham prestígio junto ao governo federal para favorecer a empresa sueca.
Ainda segundo o MP, em agosto de 2013 Lula aderiu a essa “divulgação” de que poderia haver influência no governo Dilma Roussef , reafirmando uma “venda de fumaça” para beneficiar seu filho com dinheiro que a Saab pagaria à empresa de Mauro marcondes e Cristina Mautoni.
O MP diz que Lula é responsável pelo retorno financeiro que eles tiveram da Saab, além de também ter agido pelo recebimento de R$ 2,5 mi do filho Luís Cláudio.

A respeito do pedido de bloqueio de bens do MPF/DF, a defesa do ex-presidente Lula esclarece que:
Não tem qualquer base jurídica e materialidade o pedido de bloqueio de bens formulado pelo Ministério Público Federal contra o ex-Presidente Luiz Inácio Lula da Silva e seu filho Luis Claudio Lula da Silva nos autos do Processo nº 0076573-40.2016.4.01.3400, em trâmite perante a 10ª. Vara Federal de Brasília.
O pedido foi apresentado em 27/09/2017, quando já tinham sido ouvidas as testemunhas selecionadas pela acusação (22/06) e parte das testemunhas selecionadas pela defesa (18/07, 1º/08, 10/08; 17/08 e 23/08). Como não poderia deixar de ser, nenhum dos depoimentos coletados ao longo das audiências confirmou as descabidas hipóteses acusatórias descritas na denúncia e por isso sequer foram referidos no requerimento.
Não há no pedido apresentado pelo MPF indicação de provas a respeito das afirmações ali contidas, que partem de certezas delirantes sobre a “influência” de Lula na compra de caças pelo País e na ausência de veto em relação a um dos artigos de uma medida provisória (MP 627/2013).
As testemunhas ouvidas, como os ex-Presidentes Fernando Henrique Cardoso e Dilma Rousseff, os ex-Ministros da Defesa Nelson Jobim e Celso Amorim, o Brigadeiro Juniti Saito, dentre outras, esclareceram (i) que a compra dos caças suecos pelo Brasil em dezembro de 2013 seguiu orientação contida em parecer técnico das Forças Armadas e que (ii) o artigo 100 da Medida Provisória 627/2013 prorrogou incentivos fiscais instituídos durante o governo do ex-Presidente Fernando Henrique Cardoso, objetivando o desenvolvimento das regiões norte, nordeste e centro-oeste.
As provas existentes nos autos, portanto, mostram com absoluta segurança que o ex-Presidente Lula e Luis Claudio não tiveram qualquer participação da compra dos caças suecos, tampouco na sanção presidencial do artigo 100 da Medida Provisória 627/2013. Mostram, ainda, que Luis Claudio prestou os serviços de marketing esportivo contratados pela empresa Marcondes e Mautoni e tinha expertise na área, adquirida em trabalhos realizados em algumas das maiores equipes de futebol do País e, ainda, na organização e implementação de um campeonato nacional de futebol americano. Lula jamais recebeu valores da Marcondes e Mautoni ou de terceiros por ela representados.
Essa ação penal integra o rol de ações propostas contra Lula e seus familiares sem qualquer materialidade, com o objetivo de perseguição política.
A Defesa apresentará manifestação no processo demonstrando que o pedido deverá ser indeferido pelo juiz.
