MP que ajusta nova lei trabalhista veda seguro-desemprego para trabalhador intermitente; entenda as mudanças
Medida institui contribuição adicional ao INSS em caso de receber menos de um salário mínimo e retira quarentena para migração de contrato formal para intermitente depois de 2010.
A medida provisória 808, editada pelo governo na terça-feira (14), inclui ajustes no chamado trabalho intermitente (ou esporádico), uma das novidades da nova lei trabalhista que entrou em vigor esta semana. A MP passou a valer, mas ainda pode ser modificada pelo Congresso. Entre as principais mudanças estão a necessidade do trabalhador de fazer uma contribuição adicional ao INSS em caso de receber menos de um salário mínimo para ter os benefícios da Previdência e a proibição de receber seguro-desemprego.
SAIBA TUDO SOBRE A NOVA LEI TRABALHISTA
Essa modalidade de trabalho não era prevista em lei e passou a existir com a reforma trabalhista. Nela, a empresa pode convocar o trabalhador somente quando houver necessidade. Assim, mesmo com registro de emprego, o salário é pago de forma proporcional, apenas por hora trabalhada, e o profissional contratado fica livre para formar vínculos com outras empresas.
A previsão do governo é que essa modalidade gere 2 milhões de empregos em 3 anos, só na área de serviços. A expectativa é que a nova legislação beneficie os trabalhadores informais, aqueles que deveriam ser registrados como empregados e receber os benefícios trabalhistas previstos na lei.
Entenda abaixo as regras do trabalho intermitente com os ajustes da MP 808:
Como será a remuneração do trabalho intermitente?
O trabalhador receberá o chamado salário-hora, que não poderá ser inferior ao salário mínimo ou ao dos profissionais que exerçam a mesma função na empresa, assegurado o pagamento do trabalho noturno superior à do diurno. Esse pagamento será proporcional às horas trabalhadas. Se em um determinado mês ele não for convocado, não receberá salário nesse período.
Como serão pagos os benefícios trabalhistas nessa modalidade?
O empregado terá direitos previstos como férias proporcionais ao tempo trabalhado mais o pagamento de 1/3, depósito de Fundo de Garantia do Tempo de Serviço (FGTS), descanso semanal remunerado e 13º salário, proporcionais ao período trabalhado.
Como ficam as contribuições à Previdência?
No contrato de trabalho intermitente, o empregador fará o recolhimento das contribuições previdenciárias próprias e do empregado e o depósito do FGTS com base nos valores pagos no período mensal e fornecerá ao empregado um comprovante de que cumpriu essas obrigações.
O trabalhador que não conseguir receber o equivalente a um salário mínimo terá de fazer uma contribuição adicional ao INSS para ter direito a benefícios da Previdência.
No auxílio-doença, a MP inclui que ele será pago ao segurado da Previdência Social a partir da data do início da incapacidade, mesmo que seja no primeiro dia de trabalho. O salário-maternidade, segundo a MP, será pago diretamente pela Previdência Social.
O trabalhador intermitente poderá parcelar as férias em três períodos?
Sim. O texto sancionado em julho previa que o trabalhador intermitente teria direito a um mês de férias a cada 12 meses. A MP em vigor passou a autorizar o parcelamento das férias em até três períodos.
O que deve constar no contrato de trabalho?
O contrato deverá especificar o período de trabalho que será executado, por número de horas, por dias ou por meses. Ele deve ser feito por escrito e conter especificamente o valor da hora de trabalho. A MP prevê que as partes devem definir os seguintes pontos no contrato de trabalho intermitente:
- Locais de prestação de serviços;
- Turnos para os quais o empregado será convocado para prestar serviços;
- Formas e instrumentos de convocação e de resposta para a prestação de serviços;
- Formato de reparação recíproca na hipótese de cancelamento de serviços previamente agendados.
De que forma o trabalhador será convocado?
O empregador deverá informar o profissional sobre a jornada a ser cumprida, com pelo menos três dias corridos de antecedência. A MP altera o prazo para o empregado responder a um chamado de trabalho intermitente após o recebimento da convocação. Antes, o prazo era de um dia útil. Com a MP, o prazo passa para 24 horas em qualquer dia.
Em quais casos a empresa pode convocar o trabalho intermitente?
O doutor em direito do trabalho e professor da Fundação Santo André, Antonio Carlos Aguiar, explica que essa modalidade somente deve ser acionada em casos excepcionais, quando houver um fluxo maior de trabalho na empresa e o empregador precisar de mais mão de obra.
O trabalhador com vínculo pode se recusar a trabalhar quando for convocado?
Sim. Em caso de silêncio do convocado nesse prazo será presumida a recusa, com direito do trabalhador a prestar seus serviços para outra empresa.
Se o trabalhador tiver cinco contratantes diferentes, ele terá direito a esses benefícios com todos eles? Todos esses vínculos deverão estar na carteira de trabalho e em contrato?
O trabalhador pode ter chamados de diversos empregadores, atuando para um no momento de inatividade de outro. Para os especialistas em direito do trabalho, cada contrato garantirá todos os direitos, pois regulamentará as condições de trabalho e todos os vínculos devem estar também na carteira de trabalho. Segundo eles, cada contrato é celebrado de forma independente, exceto se a prestação de serviços se der entre diversas empresas de um mesmo grupo econômico.
Quais as atividades que mais se enquadram no trabalho intermitente?
Ricardo Pereira de Freitas Guimarães, professor da pós-graduação da PUC-SP, afirma que as atividades realizadas em apenas algumas horas e dias da semana, como em festas e bufês, são as que mais representam o conceito de trabalho intermitente e terão amparo da lei. Garçons, músicos, produtores e promotores de eventos, por exemplo, costumam ser ocupações informais que geralmente recebem por dia trabalhado e que agora podem ser registradas.
Mayara Rodrigues, do escritório Aith, Badari e Luchin Advogados, explica que a lei terá efeito sobre, por exemplo, pedreiros, marceneiros, azulejistas, copeiras, motoristas, seguranças, cozinheiros, em especial dos setores de entretenimento, turismo, construção civil e serviços.
Os trabalhadores domésticos, como cuidadores de idosos, babás e piscineiros, que fazem trabalhos eventuais e são contratados por dias específicos, sendo pagos por hora, também podem se enquadrar na modalidade. As diaristas que não trabalham mais de dois dias por semana na mesma casa também poderão ser contratadas dentro da modalidade.
Se o trabalho for constante e habitual, pode ser enquadrado como intermitente?
Antonio Carlos Aguiar, professor da Fundação Santo André, explica que se houver uma regularidade do trabalho não é trabalho intermitente, ou seja, se trabalhar nos mesmos dias da semana configura trabalho normal. Se um trabalhador é chamado, por exemplo, para trabalhar de sexta a domingo configura trabalho contínuo, como é o caso de muitos garçons que trabalham com todos os requisitos de relação de emprego, como habitualidade, salário e subordinação e, portanto, têm direito ao recebimento de todos os direitos trabalhistas de forma integral.
Como é possível assegurar os benefícios se o trabalhador prestar o serviço somente uma vez para o contratante, por apenas um dia, por exemplo?
Todos os direitos e benefícios serão pagos proporcionalmente ao período trabalhado. Se o trabalhador for registrado, com contrato assinado, poderá procurar seus direitos na Justiça do Trabalho em caso de irregularidades por parte do empregador, orienta Guimarães, da PUC-SP.
Segundo Aguiar, se o direito não for respeitado ou se não for anotado em contrato específico, será aplicada então a regra geral prevista na CLT. “O contrato intermitente é exceção. Se os pressupostos não forem observados, será aplicada a regra geral, o contrato normal, com todos os direitos de modo integral”, diz.
Qual a diferença entre o trabalho intermitente e o trabalho temporário?
O trabalho intermitente é remunerado por período trabalhado, e não de forma contínua, em forma de salário mensal. Por exemplo, no trabalho intermitente, o funcionário pode trabalhar duas semanas, sair da empresa e voltar 15 dias depois. Ele recebe por dia ou hora trabalhado e não um salário mensal.
Já o trabalho temporário tem salário mensal. O contrato pode ser de até 6 meses, podendo ser prorrogado por mais 3 meses. Após o término do contrato, o trabalhador temporário só poderá prestar novamente o mesmo serviço à empresa depois de três meses.
Na lei de terceirização, sancionada em março pelo presidente Michel Temer, o trabalhador temporário é contratado por uma empresa de terceirizada, que o coloca à disposição de uma empresa tomadora de serviços para atender à necessidade de substituição transitória de pessoal permanente ou demanda complementar de serviços.
E se o trabalhador não for convocado por um mês inteiro?
Para ter renda, ele precisa ser convocado pela empresa para prestar seus serviços. Se isso não acontecer em um determinado mês, ele fica sem salário naquele período.
O que muda na multa por descumprimento do acordo com a MP do governo?
O texto sancionado em julho previa o pagamento de multa de 50% da remuneração prevista se qualquer das partes descumprisse o acordo sem justo motivo. No novo texto, empregador e trabalhador intermitente poderão fixar em contrato o formato da reparação no caso de cancelamento de serviço previamente agendado.
O período de inatividade será considerado tempo à disposição do empregador?
A MP acrescenta também que considera-se período de inatividade o intervalo de tempo no qual o empregado intermitente não foi convocado e não prestou os serviços. Durante o período de inatividade, o empregado poderá prestar serviço a outras empresas que exerçam ou não a mesma atividade econômica da primeira empresa. O período de inatividade não será considerado tempo à disposição do empregador e não será remunerado.
Por quanto tempo de inatividade do trabalhador será rescindido o contrato?
A MP inclui ainda a previsão de que será considerado rescindido o contrato de trabalho intermitente caso o empregador fique por um ano ou mais sem convocar o trabalhador para serviços.
Quais os direitos do trabalhador intermitente na rescisão do contrato?
Prevê também que, extinto um contrato de trabalho intermitente, o empregador deverá ao trabalhador, pela metade, aviso prévio indenizado; indenização sobre FGTS; e, na integralidade, demais verbas trabalhistas, se houver.
O trabalhador terá direito ao seguro-desemprego?
Ainda segundo o novo texto, a extinção do contrato de trabalho intermitente, porém, não autoriza o trabalhador a requerer o seguro-desemprego.
O trabalhador poderá sacar o dinheiro do FGTS ao fim do contrato?
Outro ponto incluído no novo texto é a permissão para que o trabalhador movimente sua conta do FGTS quando da extinção do contrato de trabalho intermitente. Os saques, porém, ficam limitados a 80% do saldo previsto na conta.
Haverá uma carência para o trabalhador demitido ser recontratado pela mesma empresa?
A MP prevê que serão necessários 18 meses de intervalo para a mudança de um contrato por tempo indeterminado para o intermitente, mas essa quarentena valerá somente até 31 de dezembro de 2020. Portanto, o empregado formal que for demitido não poderá prestar serviços para o mesmo empregador como intermitente por um ano e meio. Depois de 31 de dezembro de 2010, entretanto, será possível demitir o empregado e recontratá-lo imediatamente como intermitente.
